    More like if Ford were to design a car such as the Mustang (which they have), and someone were to come along and mass-produce a car that looks, and is easily mistakable, for a Mustang (which no one has).

    The Camaro looks nothing like the Mustang, yet they both come in black, have 2-doors and v8 engines. Keep trolling.

    we're also talking about a device a hundred times smaller. since way before the debut of the iphone, smartphones have been rectangular. adding a touch-screen necessitates minimal adornment. what apple is essentially trying to say--in your own admitted description--is that it wants to eliminate the possibility of anyone designing a device that has the functionality of an iphone.

    Samsung vs Apple was more about design, not functionality. The two are not easily confusable - how are you doing that?

    And regardless of size, a phone can be made to look different. The phones now look nothing like that did in 2001.

    Cologne bottles - same functionality, but each popular brand looks different enough from another as to not let them easily be confused when seen on the same shelf.

    More:
    Wristwatches (Rolex vs Casio), sunglasses (Oakley vs Rayban), laptops (Sager vs Apple), etc - all the same functionality, different signature designs, and all a hundred times smaller than the cars (Mustang vs Camaro) comparison.

    Should I keep going?

    Shit, I think Boeing and Airbus look pretty similar.
    All these LCD TVs on the market, they look similar too.
    Damnit I get so confused, when I shop for Toilets and mailboxes, they look too damn similar.
    My hamper to hold my clothes looks similar to others for sale.
    Shit my basic dryer and washer look similar to the other washer and dryers on the market.
    Fuck who the hell invented utilitarianism. Basic form and function makes products look too similar.

    I want a pyramid tablet.



    Why the hell would I want a retangular phone when the screen in rectangular. Why would I want it black when the screen off is black, why would I want a speaker on top and microphone on bottom, why would I want a button on the bottom of the screen instead of the top (i really want to reach over the screen i'm looking at to press it)?

    I didn't know lack of identifying features was a copyrightable thing? Shit, I need to patent my human body without tattoos. Everyone else needs to get a unique tattoo, or i'm going to sue them for copying me.

    Need I go on?

    Oh, i'll throw another in there, AMC Movies should sue Regal Cinemas, their screens in the theatre look too similar, they both sell popcorn and soda, and both charge too much for movies.

    Congratulations, you just listed a bunch of stuff that was unique and patentable at one time, but later became standard and essential.

    No one, not even Apple, said you can't make a tablet that is rectangular with rounded corners. The new Kindle Fire HD is a rectangle with rounded corners, with a bezel and front-facing camera. Yet doesn't necessarily look like an Apple product. Get it?

    I see an example of this every day. I have a client that comes in with his Android Galaxy Tab tablet. He's not technically savvy at all, yet he refers to it as an iPad. I feel the urge to remind him that it's not an iPad, but rather a tablet made by Samsung, yet I don't have the heart. He sees the design similarities, and assumes they're the same (in looks, functionality and quality). Any marketing Apple does for their iPad, spending money on advertising, etc, directly benefits those tablets like the Galaxy Tab that looks so similar to it. How is that even close to fair?

    My point is that its a basic design, and even your comment on the Fire does not pass the test. That first image is the Kindle Fire HD. Its a black rectangle with rounded corners. Its called utilitarianism.

    The XYBoard is ugly, and just one example of purposefully going against the grain.


    Also, the back of the Galaxy Tab looks different too

    And that's why Amazon hasn't been sued over the Fire? (at least not yet, and not likely in the future)

    As I said, this never was about patenting a shape or color, no matter how much anti-Apple haters try to make it out to sound.

    And regarding the xyboard, yeah it's ugly, but it still functions perfectly well as a tablet that doesn't look like something out of Cupertino..
