    Uhh, then they better damn well drop the charges as he wasn't breaking any laws. Cut and dry. The dumbass officer who issued it warranted the ticket based on emotion. That and the fact that people in large groups are very, very stupid. As long as he didn't unholster the firearm, they CANNOT get him on any brandishing charges either.

    (a) A PERMIT TO CARRY A CONCEALED HANDGUN AUTHORIZES THE
    PERMITTEE TO CARRY A CONCEALED HANDGUN IN ALL AREAS OF THE STATE,
    EXCEPT AS SPECIFICALLY LIMITED IN THIS SECTION.
    A PERMIT DOES NOT
    AUTHORIZE THE PERMITTEE TO USE A HANDGUN IN A MANNER THAT WOULD
    VIOLATE A PROVISION OF STATE LAW. A LOCAL GOVERNMENT DOES NOT
    HAVE AUTHORITY TO ADOPT OR ENFORCE AN ORDINANCE OR RESOLUTION
    THAT WOULD CONFLICT WITH ANY PROVISION OF THIS PART 2.

    (b) A PEACE OFFICER MAY TEMPORARILY DISARM A PERMITTEE,
    INCIDENT TO A LAWFUL STOP OF THE PERMITTEE. THE PEACE OFFICER SHALL
    RETURN THE HANDGUN TO THE PERMITTEE PRIOR TO DISCHARGING THE
    PERMITTEE FROM THE SCENE.

    (2) A PERMIT ISSUED PURSUANT TO THIS PART 2 DOES NOT AUTHORIZE
    A PERSON TO CARRY A CONCEALED HANDGUN INTO A PLACE WHERE THE
    CARRYING OF FIREARMS IS PROHIBITED BY FEDERAL LAW.

    (3) A PERMIT ISSUED PURSUANT TO THIS PART 2 DOES NOT AUTHORIZE
    A PERSON TO CARRY A CONCEALED HANDGUN ONTO THE REAL PROPERTY, OR
    INTO ANY IMPROVEMENTS ERECTED THEREON, OF A PUBLIC ELEMENTARY,
    MIDDLE, JUNIOR HIGH, OR HIGH SCHOOL; EXCEPT THAT:

    (a) A PERMITTEE MAY HAVE A HANDGUN ON THE REAL PROPERTY OF
    THE PUBLIC SCHOOL SO LONG AS THE HANDGUN REMAINS IN HIS OR HER
    VEHICLE AND, IF THE PERMITTEE IS NOT IN THE VEHICLE, THE HANDGUN IS IN
    A COMPARTMENT WITHIN THE VEHICLE AND THE VEHICLE IS LOCKED.

    (b) A PERMITTEE WHO IS EMPLOYED OR RETAINED BY CONTRACT BY
    A SCHOOL DISTRICT AS A SCHOOL SECURITY OFFICER MAY CARRY A
    CONCEALED HANDGUN ONTO THE REAL PROPERTY, OR INTO ANY
    IMPROVEMENT ERECTED THEREON, OF A PUBLIC ELEMENTARY, MIDDLE,
    JUNIOR HIGH, OR HIGH SCHOOL WHILE THE PERMITTEE IS ON DUTY.

    (c) A PERMITTEE MAY CARRY A CONCEALED HANDGUN ON
    UNDEVELOPED REAL PROPERTY OWNED BY A SCHOOL DISTRICT THAT IS USED
    FOR HUNTING OR OTHER SHOOTING SPORTS.

    (4) A PERMIT ISSUED PURSUANT TO THIS PART 2 DOES NOT AUTHORIZE
    A PERSON TO CARRY A CONCEALED HANDGUN INTO A PUBLIC BUILDING AT
    WHICH:

    (a) SECURITY PERSONNEL AND ELECTRONIC WEAPONS SCREENING
    DEVICES ARE PERMANENTLY IN PLACE AT EACH ENTRANCE TO THE BUILDING;

    (b) SECURITY PERSONNEL ELECTRONICALLY SCREEN EACH PERSON
    WHO ENTERS THE BUILDING TO DETERMINE WHETHER THE PERSON IS
    CARRYING A WEAPON OF ANY KIND; AND

    (c) SECURITY PERSONNEL REQUIRE EACH PERSON WHO IS CARRYING
    A WEAPON OF ANY KIND TO LEAVE THE WEAPON IN POSSESSION OF SECURITY
    PERSONNEL WHILE THE PERSON IS IN THE BUILDING.

    (5) NOTHING IN THIS PART 2 SHALL BE CONSTRUED TO LIMIT,
    RESTRICT, OR PROHIBIT IN ANY MANNER THE EXISTING RIGHTS OF A PRIVATE
    PROPERTY OWNER, PRIVATE TENANT, PRIVATE EMPLOYER, OR PRIVATE
    BUSINESS ENTITY.
    I'd assume they're going to drop the charges as the law so states... No laws were broken. Just irrational subjective patron behavior and bad police work of upholding the law.

    intentionally, knowingly, or recklessly carries a handgun under the
    authority of Subchapter H, Chapter 411, Government Code, regardless of
    whether the handgun is concealed, on or about the license holder's
    person:

    Let's be real though, if some crazy motherfucker just killed a dozen people in a movie in your state you should probably conceal your weapon a little bit - whether it's legal or not. Obvious to him he wasn't breaking the law but he has to be some special kind of stupid to think everyone knows the law, and that no one would have an adverse reaction to him sitting in a move theater with a gun showing after what happened.

    Based on what I can find, he was not only being stupid but he WAS breaking the law.

    Lots of conflicting info on the web. Upon further review, Denver will do everything they can to make his life suck, but you appear to be right. Please bump this when the charges get dropped.

    Regardless, he was asking for trouble open carrying in the wake of this tragedy. No reason not to keep it concealed.

    Apparently he visits that theatre three to four times a month and always informs the theatre manager he's packin'. His side of the story... he informed the manager, has carried, and been acknowledged by theatre management as a frequent patron known to carry for quite some time. He goes to the movies nearly every weekend and this was a typical weekend for him. He carried as usual, no different than any other instance. There's not a private property disarm or patron disarm mandate at that particular venue. It's okay to CCW there. I don't get why the gave him a chickenshit ticket!

    Here's a further comment and some answers for you Adam, taken from here: James G. Mapes Allegedly Brought Gun Into Movie Theater Near Aurora

    "I was a threat to no one," Mapes told the Post. "I didn't threaten anybody."

    Mapes said he has a concealed-weapon permit. He was arrested after someone told police Mapes had a handgun in the movie theater.

    "We are an open-carry state," Thornton police spokesman Matt Barnes said. "We look at the open-carry law and how it relates to this incident. He felt he was exercising his right to bear arms in an open-carry state, and we are currently reviewing that with our prosecutors."

    KOA reported Mapes was wearing a shirt that said "Liberalism leads to terrorism." When asked about the shirt, Mapes said he put it on earlier in the day and "didn't think about how it would connect to the gun," according to the station.

    When one man could cause so much evil - think about how much love we can create together.
    Just thought of this today...it was as a reaction to the mass shooting/bombing in Norway last year. Isn't it odd that in a country like the US, the first thoughts after any attack are more security, more weapons, more laws, and to roast the guy who did it...and yet in Norway their first thought is not to let such an attack lead them to abandon their values in the name of security?
