The first lawsuit was over design. The latest one (trying to ban the Galaxy tab in the United States) is mostly over how users navigate pictures on the device. And like I stated before,. I've used both devices and can't see how Samsung copied anything in that aspect. Maybe Apple doesn't want them using swipe technology?

There were 4 main issues that Apple brought up to the courts (1 utility, 3 designs), and it's the design patents that the judges seem to be acknowledging.

In general terms the design patents cover more than looks, but feel as well. It's like how Dodge's "signature" is the grill crosshairs, while Apple established early on what an Apple product should look and feel like compared to the competition.

Since the market is becoming more and more saturated with a plethora of smart phones, I think this water will become more and more murky. It's like phones are cross-breeding as everyone is stealing ideas from eachother, which is inevitable, especially when you have a product that is selling really well.

I think Samsung will be just fine, everything that makes the Tab great will come out in another form factor and can quite possibly be leaps and bounds over anything else currently on the market. I'm rooting for all companies to do this, as the stronger the competition, the more we (the consumers) will benefit with unique and awesome products.

The Chinese are apparently an exception to the rule. They copy everything. Heck, they even made fake Apple Stores:
