Can a little of that be expected on a new build?
Used a throw away $8 filter for the first 10 minutes, then went to the bigger HP2007 K&N. If I get flakes in the oil that will be changed probably tomorrow, I will be yanking the damn thing out, and putting her back on the stand...

You shouldn't be having a problem with those clearances. Did you use a new oil pump and check the tolerances in it?
That oil is too dirty. It should be much cleaner (particle-wise). Discoloration is normal if you used assembly lube.
What was in the oil system that was reused? Oil lines, cooler, lifters, etc. Something wasn't cleaned out well enough. I didn't want to believe it either with my builds but that's more than likely the cause.
Pump had 3k or less, the returns were cleaned and reused, all else new.
