I don't see how he could be charged... It's not like you are in full control when taking extreme action to protect your child.

While I'm eternaly thankful I never had to deal with a situation like this, I can relate in a small way... When my daughter was about 4, she was attacked by a large dog right in front of me in our yard. That was 20 years ago. And to this day, I have no clue where that 2X4 came from....

He wasn't torchered enough! Worst crime ever! I have a sister who was molested as a child she can't function normal at all and this happened over 30 years ago. This causes perminate damage to the brain (PTSD).

I am in Dad's corner all the way down the line here, but I wonder how the line of acceptability gets drawn to begin with.

If I caught a guy molesting my infant daughter, I would surely beat him with the intent of killing him, but...



I would do the same thing if someone attacked my adult daughter, my wife, or anyone I loved and who couldn't adequately defend themselves, and I think that would include my pets.

I don't have a butt-load of links to back-stop my supposition that society will excuse similar actions in some situations but not in others, but there isn't a whole lot of consistency to such outcomes, I don't think.

I have argued the point with some Brits, for example, who will argue 'til the cows come home that one literally has no right to defend one's self against intruders in the home, even a non-thief who is there merely to commit an assault of some type.

The legal battle over a right to self-defense (and to defend others as well) is ongoing, and one I am watching with intense interest.

Bingo - I think that is the root of the intent; being caught red-handed, one foregoes the impediment of a finding of guilt, paving the way for immediate administration of punishment.

As a relatively new father I completely understand the father's actions.

Reading the story yesterday, I gathered that the father didn't really mean to kill him. And in that regard, he and I have something in common. I would not have tried to kill him either. I would have done much worse. By the time I was done with him, he would have wished I had just killed him.
