It looks like Apple, Inc. (AAPL) has become Google Inc.'s (GOOG) latest foe to commit a legal blunder.

Webwereld.nl, the Dutch counterpart to Computerworld, was poking around in Apple's case files in its lawsuit [1][2] against Android device maker Samsung Electronics Comp., Ltd.'s (SEO:005930), when it noticed something interesting. An "exhibit" showed how similar the iPad 2 and the Galaxy Tab 10.1 appeared -- but something wasn't quite right.

The Galaxy Tab was stretched via Photoshop or some image editor to look like it had the same dimensions as the iPad 2. The Galaxy Tab was reduced from a 1.46 aspect ratio (for the tablet, no the display) down to a more iPad-like 1.36. The iPad has an aspect ratio of 1.30.

Given that a number of Apple's claims of infringement center around claims that Samsung copied its patented iPad design, this is a pretty serious problem. Apple's claim that the products look "practically identical" is a lot more plausible if the Galaxy Tab 10.1 happens to be photoshopped to look more iPad-like.

EU lawyer Arnout Groen, a lawyer with the Dutch firm Klos Morel Vos & Schaap, suggests the mistake may be costly for Apple, stating, "This is a blunder. That such a 'mistake' is made in a case about design rights can scarcely be a coincidence. ... The aspect ratio of the alleged Galaxy Tab is clearly distorted to match the iPad more closely. Inasmuch as this faux pas will have consequences for the case is of course up to the judge. But at least a reprimand by the German judge seems to be in order."

A White Plains, New York career criminal's 2010 attempts to photoshop himself into images of volunteer work earned him over 23 years in prison. It is unknown what penalties might be in store for Apple for its own digital doctoring in this civil case.

It is also unknown whether the erroneous image was included in lawsuits filed by Apple in other international courts.

Apple chief executive and co-founder, Steven P. Jobs has bragged about his mastery of stealing ideas from others, stating [video], "Picasso had a saying - 'Good artists copy, great artists steal.' And we have always been shameless about stealing great ideas."

Mr. Jobs contends Android handset makers like Samsung, HTC, and Motorola should not be allowed to "steal" the iPad and iPhone's patented looks and designs.

Apple has succeeded in banning sales of the Galaxy Tab 10.1, for the time being, in Australia and in the European Union. Samsung will appeal the European Union ban in court on August 25.

Apple appears to have the dubious distinction of joining the likes of Viacom, Inc. (VNV), whose copyright infringement case against Google was dashed when it was revealed that Viacom employees themselves uploaded some of the infringed content to Google's YouTube, and Oracle Corp. (ORCL), whose patent infringement case against Google's Android was hampered when a deleted corporate blog post surfaced in which Sun's former CEO appeared to okay the use. Either Google has the skills of a magician when it comes to pulling legal rabbits out of the hat, or Google's foes are a bumbling bunch, depending on how you want to look at it.

In related news Google recently acquired Motorola Mobility, Inc. (MMI) in a blockbuster deal worth $12.5B USD. The deal gives Google access to 17,000 patents, which it can use to defend its Android partners. Aside from Samsung, both Motorola and HTC Corp. (SEO:066570) -- the other two of Android's top three -- are also being sued [1][2][3].

Apple has been going in the shitter. Their hardware quality is nowhere near what it was 5 years ago. My first gen iPod nano had one issue when I got it that was fixed in 2 days (shipped to Cali and back! DHL was the shit) and it's still trucking along now. My 3rd gen nano had the screen slightly tilted inside the iPod... Wasn't bad but still... My iPod Touch has been terrible. The battery didn't even last a year and a half and I rarely used it. Got it warrantied with AppleCare and they sent me a refurbed one... The screen quality was atrocious in comparison. The new screen had color banding, it was washed out, and it was really grainy. Even worse, the refurbed one has a power button that rarely works so I can't reset the damn thing when it crashes (way too often for my taste) My mom's iPad is really sluggish for some reason, and the screen quality is also pretty poor considering they claim that it's fantastic... Apple isn't even competitive in software on smartphones and tablets. The App Store is still very poor to navigate, and loaded with craploads of the same app. The new OS X stuff is all much buggier than it used to be. Hell, I got my Droid back in the day when iOS was infinitely better than Android in almost every way and now it's flip flopped drastically.

The only way Apple can continue being competitive is to sue the pants off of someone that makes a similar product. Yay for greed.

Got the first nano when it came out. Nothing could withstand the abuse I've given it, & it still works fine.

Bought an Iphone a couple months ago when they were $50, had to send it back because of the "Home" button locking up.

While this *could* be major, I'm having a hard time believing the courts made their judgement based on one photo alone... let alone photos from only Apple's side of the table. And you're telling me some random journalist from Webwereld.nl noticed this and pointed it out before Samsung's highly-paid and trained patent defense lawyers? Yeah, something doesn't add up here. :p

If this is Apple playing dirty, I don't endorse it. I'd love to hear the full story though.

apple is clinging by its eyeteeth to relevance. it's had to resort to lawsuits out the ying-yang to try and stop the flood of consumers to competing products.

my prediction is that the VAST MAJORITY (if not all) of these suits from apple will be overruled; and apple stock will tank.

I definitely find that to be the most game changing news to appear over the last few weeks. Whether you wish for Apple's death or not, there's no question that Apple will need to step up there game in order to stay competitive. We're bound to see some great new innovations in the mobile market over the next few years.

Google refers to an earlier Oracle document where Oracle admits that it isn't aware of any commercial products that are marked as using the patents. As such, Google argues it shouldn't be liable for damages until after July 2010, when Oracle notified it of the infringement.

Not to beat a dead horse, but if you guys actually read the disputed patents, absolutely none of them have to do with the size of the device that these select news blogs are stretching so hard to make an issue out of. If anything, perhaps Apple's legal team simply scaled down the photo of the Galaxy S to show exactly how similar the ratio of each design element is to their current product lineup, which may be an allowable practice if the actual size of the device isn't what's being disputed. Have either of you even read the court documents as opposed to believing what's being fed to you? Is it any coincidence that both this article and the last keep pointing to 'Webwereld.nl' as the originator of these allegations, perhaps as some attempt to drive more traffic to their blog while stirring the pot between Apple and Samsung?

Put simply, if this is not an allowable practice, the case will be thrown out -- and that'd be quite the amateur mistake on Apple's part, don't you think? :p As I said before, I suppose we'll see how it pans out.

No need to insinuate that I'm blowing Jobs, Thadd. I figured you were above that, but then again this isn't the first time you've used that insult with the people you don't agree with. Let's keep this civil.

And while seeking a preliminary injunction was indeed what Apple was shooting for (as is the case with ALL significant patent disputes), the consequences of perjury is likely not worth the temporary pay-out. I shouldn't have to tell you this, it's common sense.

it's one thing if you want to smack someone on the wrist for infringing on a patent. it's quite another if you decide that you're going to seek a preliminary injunction against them--thereby eliminating any hope of revenue they would need to fight you in court.

i'm convinced that apple can't even keep track of the lawsuits IT HAS ITSELF FILED against other companies. as i mentioned earlier, the patents they're citing are so vague, that it's akin to ford suing GM because GM also decided to make a black 2-door coupe.

furthermore, it has been noted on at least one occasion that a judge has granted an injunction on behalf of apple's request--WITHOUT EVER EXAMINING THE MATERIALS IN QUESTION...IN PERSON.

that's funny. better than 50% of everything apple has ever done was "stolen" from xerox. FACT. apple was NOT the first to put a touchscreen phone on the market. FACT. apple was not the first to put a tablet PC on the market. FACT. you can go through their entire company history, and i'll bet you $5 that you'll never find one single thing brought to market that someone else didn't think of or do first.

apple is pissed because it's NOT good at innovating; it's good at popularizing. and you can't patent that. trending is trending, the market shapes itself to what consumers want. maybe the prada didn't popularize touchscreen smartphones, but it did predate the iphone. sega watched consumers flock to a d-pad over a joystick, and they followed that trend. they did NOT clone the NES pad, they made their own controller. (i know, i've owned a master-system).

apple is flinging out lawsuits left and right and asking for rediculous shit like PRELIMINARY injunctions, because it doesn't have any room to stand on. nothing about its case holds any water. just as always, a competitor will catch on to the trends apple discovers, and undoubtedly does a better job of catering to that trend. there can't be any other outcome, because apple maintains a draconian chokehold over everything and anything apple-related.

apple is full of fail. it has been since the 90's. it started to go downhill when it started encouraging its users to start sniffing their own pretentious farts.

This clearly has nothing to do with only wanting to slap your competitors on the wrist for making a product that is so blatantly similar to yours, this is about protecting your investment (design research, intellectual property, etc), and not letting another company leech on your success. Just like any other patent dispute (or more specifically any trade dress dispute), the prosecutor in these cases won't submit to copycats, especially obvious ones. The Galaxy S and Galaxy Tab might as well be renamed Samsung Chinese iPhone Knockoff 4 and Samsung Chinese iPad Knockoff 2. The engineers of these products likely rushed these products to the market to compete with the iPhones/iPad, and figured they'd deal with the legal ramifications later. That's fine.

On that note, I assure you that Apple can keep track of the lawsuits it has itself filed against other companies. The point you refuse to acknowledge is that it's NOT just Apple suing others, its EVERYONE suing eachother:

We're at a very interesting point in technological history. Mobile devices are the wave of the future, we're just starting down this road, and ALL of these companies know this. I'm with you on the point that I don't want my taxpayer dollars going towards frivolous lawsuits, but I, along with many, attribute this problem to the current patent system - it's broken. In the meantime you can continue to blame Apple because you hate fanboys, Jobs and Apple's lineup of products, but really you're wasting your time. Your history is mixed up. Apple bought the rights to Alto GUI from Xerox, which is the way it should be done. Xerox had technology that they had no idea what to do with, and Apple made it a success. You say this like it's a crime, I say this is a skill any company could only wish to possess. And make no mistake, taking a flawed idea and making it work is indeed a skill. But you should still play by the rules of the game, and if that means buying out the technology/company, or licensing it, that is the way to go. This is NOT what Samsung is doing.

But I'm not joining your hate brigade on trying to single Apple out for taking issue with it. There's a lot of fluff tossed in on both sides (since they are actively suing eachother), but in regards to the trade dress issue, the two specific products that conflict enough visually to warrant the court's attention include:

Apple claims that the Galaxy lineup of products resembles their existing design too closely to be a coincidence. Whether this is true will be left up to the courts to decide, and of course everyone (whether you're anti-Apple or not) has differing opinions on how similar is 'too similar' to be considered a copycat.

In my opinion, Apple shot itself in the foot by striving to make too minimalistic of a design with their iPhones and iPads - which makes it a very easy target for people like Tyler here to scoff at and say you can't patent a black rectangle with rounded corners and a screen. But apparently the patent registration process, in all it's wonderfulness, begs to differ. Hence why these patents were accepted in the first place, and why I think the current patent system is flawed to begin with.

Had Apple been the Lamborghini of the mobile device platform when it came to their designs, this would have likely been less of an issue.

In the text, Apple confirms that the Galaxy S has "some non-identical elements, such as the slightly larger dimensions."

If you read the lawsuit, or even the first 25 pages of it, you'll see that the size of the device is not what's in question here.

I'm with you on the lawyers and politicians statement though, at least most of them.

Samsung violates patent EP 868 with its Galaxy S, S2 and Ace model, but not with its Galaxy tablets. Samsung does not violate patent EP 948, while patent EP 022 was considered invalid. There was no violation by Samsung on any of Apple's design or copyright ...

The EP '648 violation comes due to the scrolling functionality in Gingerbread devices' gallery. Honeycomb devices, such as the Galaxy Tab 10.1 are not affected.

Today is a big day for Apple, not necessarily for the ruling in the Netherlands courts, but because Jobs has officially stepped back from his role as CEO in order to become chairman of the board, director and simply an employ. As of today, Tim Cook is the new CEO.

Not that I have any Apple stock personally (I bet you're surprised, aren't you), but that'd be unwise.

This resignation was strategic, and likely planned out quite some time in advance. Not to mention, Apple's roadmap for at least the next 3-5 years worth of products has probably been established, and will likely be left unaffected.

For those that don't know, Jobs has now joined the ranks of Gates as a 'once upon a time' CEO that traded his position in order to become simply Chairman of the Board.

The question is whether or not Tim Cook will be next Ballmer, which in all honesty I don't foresee happening. ;)

He's very well spoken. Seems to lead naturally. From what I gather, yesterday's changing of the guard was merely a formality; Cook has been running the show there for at least a year now. He certainly seems to be less arrogant than Jobs with more people skills.

if Apple were to sue Google directly over this particular patent, the could conceivably get an injunction.

That's another case somewhere further down the line, if it happens at all.

It seems to me that it is actually the sensationalized media whom are the ones grasping at straws here. This stuff hasn't even happened yet (and is likely NOT to happen, as Apple needs competition), and you guys are already buying into it like it has. Plus that article (and its source) said nothing about Apple claiming to have 'started Android' (as a whole), but rather only an API that iOS and Android supposedly share in common.

And as far as the article that Thadd posted, from which - by the way - is just seething with objective reporting :rolleyes: (love the red eyed Steve Jobs and image captions implying that Apple is going after ALL Android phones, when in reality they're mostly only going after Samsung's Galaxy lineup), most of this stuff only further goes to show that the patent system is broken. Yes everyone has too many patents, and yes Apple has been forced to patent just about everything having to do with their products as well (they even said this during the keynotes for the first release of the iPhone), but it's all pretty ridiculous. Where is the hate for Nokia as they claimed to own the patents for, and actively sued over, the commonly used concept of GSM calling, 3G data, and Wi-Fi (http://www.electronista.com/articles/09/10/22/nokia.says.iphone.violates.gsm.3g.patents/) on a handheld device? Here's another one, just reported about earlier today, regarding some big names getting sued over some common Wi-Fi and LTE patents (Apple, HTC, More Sued Over Wi-Fi, LTE Patents (http://www.pcmag.com/article2/0,2817,2392383,00.asp)).

Anyway, Apple is right in pointing out that the patent monopoly is a major issue, but I doubt they were 'crying' about it. If anything, they mentioned one word about it in their testimony, and a few low-level media outlets/blogs took it and blew it up. Then you guys eat it up like candy.

Because Apple has wronged me and their elitism pisses me off. My iPod Touch is a POS and it's Apple's fault. You can go back in this thread and read why I hate Apple.

Oh, and to add more to why I hate Apple, iTunes pops up a message every single time I open it telling me I don't have the proper drivers installed and I need to reinstall. I've reinstalled a lot of times trying to fix it, I've followed their guide on fixing the registry and guess what... It's still broken.

It works almost fine. The on/off switch is borked, but the screen needs replaced. Not worth it but thanks.
